Apa yang dimaksud dengan pencegahan dalam imigrasi?

Berdasarkan Pasal 1 Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian disebutkan bahwa pencegahan adalah larangan sementara terhadap orang untuk meninggalkan Wilayah Indonesia berdasarkan alasan keimigrasian atau alasan lain yang ditentukan oleh undang-undang. Berdasarkan Pasal 91 Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian disebutkan Menteri melakukan pencegahan berdasarkan:

  • hasil pengawasan Keimigrasian dan keputusan Tindakan Administratif Keimigrasian;
  • keputusan Menteri Keuangan dan Jaksa Agung sesuai dengan bidang tugasnya masing-masing dan ketentuan peraturan perundang-undangan;
  • permintaan Kepala Kepolisian Negara Republik Indonesia sesuai dengan ketentuan peraturan perundang-undangan;
  • perintah Ketua Komisi Pemberantasan Korupsi sesuai dengan ketentuan peraturan perundang-undangan;
  • permintaan Kepala Badan Narkotika Nasional sesuai dengan ketentuan peraturan perundang-undangan; Dan
  • keputusan, perintah, atau permintaan pimpinan kementerian/lembaga lain yang menurut undang-undang mempunyai kewenangan Pencegahan.

Menteri Keuangan, Jaksa Agung, Kapolri, Ketua Komisi Pemberantasan Korupsi, Kepala Badan Narkotika Nasional, atau pimpinan kementerian/lembaga yang mempunyai kewenangan preventif bertanggung jawab. atas keputusan pencegahan, permintaan, dan perintah yang dibuatnya.

Pencegahan ditetapkan dengan keputusan tertulis. Keputusan pencegahan harus dikomunikasikan kepada orang yang dicegah selambat-lambatnya 7 hari sejak tanggal pengambilan keputusan. keputusan tersebut juga disampaikan kepada Menteri paling lambat 3 hari sejak tanggal keputusan ditetapkan dengan permohonan untuk dilaksanakan.

Menteri dapat menolak pelaksanaan keputusan pencegahan apabila keputusan pencegahan tersebut tidak memenuhi ketentuan yang berlaku, seperti:

  • nama, jenis kelamin, tempat dan tanggal lahir atau umur, serta foto yang dapat dicegah;
  • alasan untuk melakukan pencegahan; Dan
  • periode pencegahan.

Untuk jangka waktu pencegahan berlaku paling lama 6 bulan dan bila diperpanjang paling lama 6 bulan. Dalam hal ini tidak ada keputusan perpanjangan jangka waktu pencegahan, pencegahan berakhir demi hukum.

Prevention ends because of certain things like:

  • revoked based on a written decision by the Minister or the official authorized to establish Prevention;
  • revoked by the official who determined the prevention based on the Decision of the State Administrative Court with permanent legal force; or
  • based on a court decision with permanent legal force stating that he is free on the case that is the reason for Prevention

What is deterrence in immigration?

Based on Article 1 of Law Number 6 of 2011 concerning Immigration, it is stated that deterrence is a prohibition on foreigners from entering Indonesian Territory based on immigration reasons.

Deterrence is also established by written decision. a deterrence decision on the request of an official shall be issued by the Minister no later than 3 days from the date on which the request for deterrence is submitted. Notice of denial of a request for deterrence must be given to the Officer no later than 7 days from the date the request for deterrence is received along with the reasons for the refusal. The Minister may reject a request for deterrence if the request for deterrence does not meet applicable regulations, such as:

  • name, gender, place and date of birth or age, as well as photos subject to deterrence;
  • reasons for deterrence; and
  • period of deterrence.

For a period of time, deterrence is valid for a maximum of 6 months and when extended for a maximum of 6 months. Just like prevention, there is no decision to extend the period of Denial, Deterrence ends in favor of law.

A lifetime suspension decree may be imposed on Foreigners who are deemed to disturb security and order. For Indonesian citizens, deterrence cannot be imposed because it is not in accordance with international principles and customs, which state that a citizen should not be prohibited from entering his own country.

Deterrence ends due to certain things such as:

  • the stipulated period has expired; or
  • revoked by the Minister.
